Can a permanent employee be terminated?
Given the structure of Indian labor laws, there is no standard process to terminate an employee in India. An employee may be terminated according to terms laid out in the individual labor contract signed between the employee and the employer. Equally, the terms may be subject to the country's labor laws.
How do I lodge a complaint with Fair Work Australia?
If your complaint is about ending employment including unfair dismissal, unlawful termination or general protections, or about bullying, harassment or discrimination at work, you should contact the Fair Work Commission on 1300 799 675.
What entitlements do I get when I resign?
An employee should get the following entitlements in their final pay:
- outstanding wages for hours they have worked, including penalty rates and allowances.
- any accumulated annual leave, including annual leave loading if it would have been paid during employment.
- if it applies: accrued or pro rata long service leave.
